Benjamin T. McLawhorn is a committed attorney, business owner, former educator, and North Carolina native. A skilled and relatable lawyer, Ben understands his clients’ unique circumstances and earns their trust as they seek his guidance in the areas of employment law, Social Security disability, and family law. Ben has taken on various educational endeavors by earning an Associate in Applied Science in Welding Technology from Pitt Community College, a Bachelor of Science in Applied Geography from East Carolina University, and a Juris Doctor from North Carolina Central University School of Law. Prior to becoming an attorney, Ben was a welder and welding instructor. As an employee himself, he chose to pursue a career in law to help those who need a trustworthy, compassionate, and understanding attorney.

Ben is known as a dedicated attorney who represents working men and women in North Carolina. He is honored to bring that experience to McLawhorn & Russell, PLLC while making a difference in the lives of those needing reliable legal representation. As a former welder and tradesman, Ben spent years observing the hard work and physical labor of his colleagues, apprentices, and students. Their experiences fuel his passion for employment law.

He focuses on various areas including, but not limited, to workplace safety, equal opportunity, pay and compensation, noncompete clauses, and severance agreements. He has dealt with private companies, nonprofit organizations, and government agencies. Acting as an appointed representative, Ben also handles Social Security disability cases, where he fights to get people the disability benefits they deserve. As a well-rounded family law attorney, he is experienced in marital agreements, separation, divorce, child custody, child and spousal support, name changes, and adoption.

As a divorcee himself, Ben strives to guide spouses and families through difficult and challenging situations with honesty and integrity. His practice is focused on using individualized litigation approaches while ensuring the rights and interests of his clients are protected. Ben formerly worked for Pierce Law Group, PLLC as an Associate Attorney and served as a legal intern for the North Carolina Central University Office of Legal Affairs.

In an effort to give back to his community, Ben is passionate about volunteering in the service of others. He has worked with both Urban Ministries in Durham and the Food Bank of Central and Eastern North Carolina. He has also used his legal expertise to represent cases on a pro bono capacity and was recognized by Marquis Who’s Who as a leader in the field of law.

Ben is active in the North Carolina Bar Association, where he serves on the membership committee. In that role, he works to encourage other attorneys to become involved in the Bar Association’s numerous community projects. Along with his license to practice law in the State of North Carolina, Ben has been admitted to the Eastern and Middle Districts of U.S. District Court in North Carolina, as well as, the Fourth Circuit Court of Appeals.
